MIGUA Fugensysteme GmbH
Dieselstr. 20
42789 Wülfrath

Scope of application

This data protection statement provides users with information on the type, scope and purpose of the collection and use of their data by the responsible provider.

The legal framework for data protection is formed from the Bundesdatenschutzgesetz (BDSG) [Federal Data Protection Act] and the Telemediengesetz (TMG) [Telemedia Act].

Collection of general information

Every time these services are accessed, information is automatically collected by us or the webspace provider. This information, categorised as server log files, is of a general nature and cannot lead to any conclusions being drawn about you personally.

Information collected includes: Website name, file, date, volume of data, web browser and web browser version, operating system, the domain name of your internet provider, the so-called referrer URL (the page from which you accessed our services) and the IP address.

Without this data, it would not be technically possible to deliver and display all the website content. In this respect, it is absolutely essential to collect this data. In addition to this, we use anonymous data for statistical purposes. It helps us to optimise our services and our technology. We also retain the right to check the log files retrospectively, should there be a suspicion that our services have been used illegally.

Handling personal information

Definition: Personal data shall mean all information by which a person is clearly identifiable. It thus means data which can be traced back to a person.

This personal data includes the first name and surname, telephone number as well as email address. Personal data also encompasses information on hobbies, memberships and preferences, as well as internet pages visited.

This data is only collected, used, and in some cases shared, provided that this is expressly allowed by legislation or the user permits the collection, processing, use and sharing of their data.

Registration on our website

If you register on our website to make use of personalised services, personal data is collected. This includes your name, address, telephone number and email address as contact and communication data.

Registration gives access to services and content that is only available to registered users. If needed, registered users are able to change or delete at any time the data provided during the registration process. Upon request, we are of course happy to let you know what personal data was collected and stored. Furthermore, we delete or correct data on demand, provided there are no legal obligations to store this. If you have any queries or would like to correct or delete data, please use the contact details provided in this data protection statement.

Newsletter

If you register for our newsletter, we will only use the data you enter for this purpose, or to provide you with information relevant to this service or the registration process. We will not share this data with third-parties.

In order to receive the newsletter, a valid email address is required. In addition, the IP address from which you registered for the newsletter and the date on which you ordered the newsletter are also stored. This data is used as proof of fraudulent activity, should an email address that is not your own be used to register for the newsletter. Furthermore, in order to ensure that an email address is not improperly entered by third-parties into our mailing list, we work in accordance with the law, adopting the so-called double opt-in process. As part of this process, the ordering of the newsletter, sending of the confirmation email and receipt of registration confirmation are logged.

At any time, you can withdraw consent for your data and email address to be stored, as well for its use in sending the newsletter. In order to withdraw consent, a link is provided in every newsletter and on the website. You can also request to withdraw consent via the contact details in this document.

Contact form

If you contact us via the online form or email, we will save the data you provide in order to answer your query and any possible follow-up questions.

Involvement of third-party services and content

Our services sometimes include content, activities and services from other providers. This includes for instance maps made available from Google Maps, videos from YouTube, links to Facebook as well as graphics and images from other websites. In order that this data can be retrieved and presented in the user’s browser, the IP address must be transmitted. The providers (termed “third-party providers” in the following) therefore have knowledge of the IP address of the user in each case.

Though we strive to use exclusively third-party providers that only require the IP address in order to deliver content, we have no influence on whether or not the IP address may be stored. This process is used for statistical purposes among other things. If we are aware that the IP address is being stored, we inform the user of this.

Google reCAPTCHA

We use "Google reCAPTCHA" (hereinafter "reCAPTCHA") on this website. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

ReCAPTCHA is intended to check whether the data entry on this website (e.g. in a contact form) is carried out by a human or by an automated program. For this purpose, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis begins automatically as soon as the website visitor enters the website. For analysis, reCAPTCHA evaluates various information (e.g. IP address, length of time the website visitor stays on the website or mouse movements made by the user). The data collected during the analysis are forwarded to Google.

The reCAPTCHA analyzes run completely in the background. Website visitors are not advised that an analysis is taking place.

The data is stored and analyzed on the basis of Art. 6 Para. 1 lit. f GDPR. The website operator has a legitimate interest in protecting its web offerings against abusive automated spying and against SPAM. If a corresponding consent has been requested, the processing takes place exclusively on the basis of Art. 6 Para. 1 lit. a GDPR; the consent can be revoked at any time.

Further information on Google reCAPTCHA can be found in the Google data protection regulations and the Google terms of use at the following links: https://policies.google.com/privacy?hl=en and https://policies.google.com/terms?hl=en.

Data minimisation

We store personal data in accordance with the principles of data avoidance and data minimisation: only for as long as necessary or prescribed by legislation (legal data retention period). If the purpose of storing the data is no longer valid or the retention period has expired, we will block or erase the data.

Your rights to information, correction, blocking, erasure and objection

You have the right to request information free of charge on the personal data stored by us and/or to demand that this is corrected, blocked or erased. Exceptions: Where it is mandatory to store the data for the processing of a business transaction or there is a legal obligation to store the data.

This also applies in cases where the data protection statement must be adapted on account of new or amended services, for example new service provisions. The new data protection statement will then take effect on your next use of our services.
